These Terms of Service (hereinafter referred to as the "Terms") apply to Boring LLC (hereinafter referred to as "the Company"), which provides the eSIM service (hereinafter referred to as "the Service"), and all customers who purchase or use the Service (hereinafter referred to as "the User").
By purchasing or starting to use the Service, the User is deemed to have agreed to all provisions of these Terms.
The Service is a data-only communication service provided using the networks of telecommunications carriers in various countries with which the Company is partnered.
The Service is exclusively for data communication; generally, voice calls and SMS (Short Message Service) are not available. However, this does not apply if specifically stated otherwise on the product page.
The Service is digital content that becomes available for use after the User downloads an eSIM profile (QR code, etc.) to a device owned by the User and configures the settings.
The Company does not guarantee operation on all devices existing in the market.
The User shall confirm, at their own responsibility, that the device intended for use meets all the following conditions prior to purchasing the Service:
The device must be eSIM compatible.
The SIM lock must be unlocked (the device must be SIM-free).
The device must support the communication frequency bands of the country where it will be used.
The OS and other software must be updated to the latest version.
The Company assumes no obligation to provide refunds or compensation if the User is unable to purchase or use the Service due to the device not meeting the above conditions resulting from a lack of confirmation by the User.
Start Date of Use (Activation): The count for the usage period (Start Date) begins when the device connects to the local network in the target country and performs data communication.
Validity Period and Data Capacity: The Service terminates when the number of days or data capacity specified in the purchased plan is reached.
Handling of eSIM Profiles: Once an eSIM profile is deleted from a device, it cannot be reinstalled (reused). Please note that if the User deletes the eSIM based on their own judgment without instructions from the Company's customer support during connection issues or similar situations, the Company cannot reissue the eSIM or provide a refund.
Refunds or exchanges will not be provided for unused data after the expiration date or for unutilized plans.
In using the Service, the User shall not engage in the following acts:
Transfer, resale, or lending of the eSIM profile to a third party.
Applications for refunds based on false declarations or unjustified chargeback (payment cancellation) requests.
Unauthorized use of the Service or network, or acts that place an excessive load on the network.
Illegal acts, acts contrary to public order and morals, or acts violating laws and regulations of the country/region of use.
Acts that obstruct the business of the Company or telecommunications carriers.
If any prohibited act is confirmed, the Company may suspend the use of the Service or take legal measures without prior notice.
Refunds for the Service shall be subject to the Refund Policy established by the Company.
Due to the nature of digital products, cancellations for the User's convenience after the QR code has been sent are generally not accepted, except as provided in the Refund Policy.
In the event of any inconsistency between these Terms and the Refund Policy, the provisions of the Refund Policy shall prevail.
Communication quality, speed, and coverage areas depend on the provision status of local carriers, network congestion, terrain, buildings, weather, and the User's device settings. The Company does not guarantee perfect communication quality at all times.
Fair Use Policy (FUP): Even for "Unlimited Plans" or similar, if excessive data communication is performed within a short period, the local telecommunications carrier may restrict communication speeds or temporarily suspend use according to their regulations. In such cases, the Company bears no responsibility and such cases are not eligible for refunds.
The Company is not responsible for unavailability or damages caused by the following reasons:
Use outside the telecommunications carrier's coverage (service area).
Malfunctions of the User's device, settings, OS, or applications.
Regular or emergency maintenance by telecommunications carriers.
If the Company determines that the Service was unavailable due to reasons attributable to the Company, the compensation amount shall be limited to the purchase amount paid by the User to the Company.
The Company manages personal information provided by the User appropriately in accordance with the Company's Privacy Policy and relevant laws and regulations. The User agrees that technical information and other necessary data may be shared with partner telecommunications carriers (including overseas carriers) to the minimum extent necessary for connection to provide the Service.
Governing Law: The formation, validity, performance, and interpretation of these Terms shall be governed by the laws of Japan. This applies regardless of the User's country of residence or the country where the Service is used.
Jurisdiction: In the event of a dispute between the User and the Company arising from or related to the Service, the Tokyo District Court shall be the exclusive agreement jurisdictional court of the first instance.
The Company may amend these Terms in accordance with the Civil Code if necessary for the operation of the Service. In the event of significant changes, the Company will notify Users by posting on the website or via email. Continued use of the Service after the changes implies the User's agreement to the amended Terms.
